These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” “User,” “Customer”), and Servixo (“we,” “our,” “us,” or “Servixo”), concerning your access to and use of our website https://theservixo.com/ (the “Website”), as well as any booking services, offline communications, partner programs, and local service coordination provided by us under the slogan “Kaam Koi Bhi, Solution SerVixo”.

By accessing the Website, booking services via our integrated WordPress booking system (Etoile Web Design’s Ultimate Appointment Scheduling plugin), clicking our custom WhatsApp redirection links, calling our phone desk, or submitting an application to join our Partner Network, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions.

If you do not agree with all of these Terms and Conditions, you are strictly prohibited from using the Website and our services, and you must discontinue use immediately.

1. Servixo’s Role as an Intermediary Marketplace

Servixo operates as a highly localized service aggregation and matching platform. We act as a digital and operational bridge connecting independent service professionals, technicians, teachers, digital creators, and local vendors (collectively, “Service Partners”) with customers seeking these services (“Users”) in Kabilpur, Darbhanga, and surrounding regions in Bihar.

A. Intermediary Status Under Indian Law

In accordance with Section 2(1)(w) of the Information Technology Act, 2000 (as amended), Servixo acts strictly as an “Intermediary”.

  • Independent Contractors: Service Partners are independent business entities or freelance professionals. They are not employees, agents, joint-ventures, or partners of Servixo. Servixo does not run a direct service company; rather, we provide the platform where demands are matched with local labor and professional talent.
  • The Service Contract: When you book a service, the contract for the actual performance of the service is established directly and exclusively between you and the Service Partner. Servixo is not, and shall not become, a party to any contractual relationship between the Customer and the Service Partner. Consequently, Servixo has no control over, and guarantees absolutely nothing regarding, the quality, safety, timing, legality, or suitability of the services performed by Service Partners.

2. Eligibility & User Obligations

To register, book services, or interact with Servixo, you must meet and comply with the following eligibility requirements:

  1. Legal Capacity: You must be at least 18 years of age and possess the legal authority to enter into a binding agreement under the Indian Contract Act, 1872. If you are registering or booking on behalf of a minor (such as hiring a home tutor for a child), you represent that you are the minor’s parent or legal guardian and agree to supervise all interactions.
  2. Accuracy of Information: You agree to provide true, current, complete, and accurate information during the booking process. This includes your real name, an active mobile number, a functional WhatsApp number, and a detailed physical address in Darbhanga (complete with landmark details). Providing false information or impersonating someone else may result in immediate termination of your service booking and a permanent ban from our platform.
  3. Residential and Commercial Access: By booking an on-site service, you warrant that you have the legal right, ownership, or authorized tenancy to grant our Service Partners access to the specified premises (residential home, office, shop, or agricultural land).

A. The Booking Steps

B. Scheduling Limitations

While we strive to match you with a provider for your selected time slot, all bookings are subject to Service Partner availability. Servixo does not guarantee that a professional will be available at your exact requested time. We will notify you as quickly as possible (usually within 15 minutes) via WhatsApp or phone call to propose alternative arrangements if your chosen slot is unavailable.

4. Financial Terms: Pricing Estimates, Direct Payments, and Materials

To ensure maximum security and protect our local community from online payment fraud, Servixo does not handle, process, or store financial payments directly on our Website.

A. Estmated vs. Actual Pricing

Any pricing structures, standard rates, or fee estimates displayed on our Website or communicated via WhatsApp are intended as baseline estimates only.

  • Scope-Based Adjustments: The final price for any job is determined based on the physical inspection of the work site by the Service Partner. Factors such as the complexity of the job, structural issues, height requirements, and time duration may affect the final cost.
  • Prior Agreement: The Service Partner must communicate the final quote to you before starting any physical work. Once you give your verbal or written consent to the quote, the price becomes binding for that specific job.

B. Direct Offline Payment Model

  • No Cards, No Wallets on Site: We do not collect credit cards, debit cards, net banking details, or digital wallet links on https://theservixo.com/.
  • Direct Settlement: You agree to pay the Service Partner directly after the job has been completed to your satisfaction.
  • Accepted Channels: Payments must be made directly to the Service Partner using Cash or via standard UPI (Unified Payments Interface) apps (e.g., PhonePe, Google Pay, Paytm, BHIM) by scanning the partner’s personal UPI QR code or sending funds directly to their phone number.
  • Payment Security Warning: Servixo will never send you unsolicited SMS, emails, or links asking you to enter your UPI PIN, banking passwords, or card details. Do not share sensitive financial information with anyone claiming to represent Servixo.

C. Materials and Spare Parts Policy

For services requiring physical materials or replacement parts (such as plumbing pipes, electrical wires, switchboards, AC capacitors, or painting materials):

  • Procurement: You may choose to purchase the materials yourself from local Darbhanga markets, or you may authorize the Service Partner to purchase them on your behalf.
  • Reimbursement: If the Service Partner purchases the materials, you must reimburse them in full based on the actual retail receipt. Servixo does not mark up material costs.
  • Warranty on Parts: Servixo does not provide any warranty on materials or spare parts purchased for the job. Any warranty claims must be pursued directly with the manufacturer or retail vendor of the product.

5. Cancellation, No-Show, and Dispute Resolution Framework

Because we respect the time of both our customers and our independent Service Partners, we enforce a transparent policy regarding cancellations and disputes.

A. Customer Cancellation Policy

  • Timeframe: You may cancel or reschedule your booking free of charge up to 2 hours before your scheduled appointment time by sending a message to our support WhatsApp desk (+91 9204618167).
  • Late Cancellations & Abuse: If you cancel after the Service Partner has already traveled to your location, or if you repeatedly fail to be present at the scheduled time (“No-Show”), Servixo reserves the right to charge a nominal “Travel/Convenience Fee” of up to ₹150 on your next booking or suspend your access to our network.

B. Service Partner No-Shows

If an assigned Service Partner fails to arrive at your location within 30 minutes of the scheduled window without prior notice, please contact our support desk immediately. We will work to dispatch an alternative professional as a priority or reschedule the service at your convenience.

C. Dispute Resolution and Mediation Path

If you are dissatisfied with the quality of the service delivered:

  1. Reporting: You must file a complaint with our WhatsApp support desk within 24 hours of the job completion.
  2. Review: Servixo will review the complaint, which may involve requesting photos of the work and getting a statement from the Service Partner.
  3. Mediation: While we are not legally liable for the service outcome, we value our brand reputation. We will attempt to mediate a fair resolution, which may involve having the original partner return to correct the mistake at no extra cost, or assigning a new partner at a discounted rate. Servixo does not issue cash or digital refunds, as all payments are settled directly between you and the Service Partner.

6. Comprehensive Code of Conduct and Safety Guidelines

We are dedicated to building a safe, professional, and respectful local community. Both Customers and Service Partners must adhere to a strict code of conduct during any service engagement.

A. Customer Responsibilities

  • Safe Working Environment: You must provide a safe, sanitary, and hazard-free environment for the Service Partner to work in. For electrical services, you must assist in turning off mains or power grids if requested for safety.
  • Valuables: You are highly advised to secure all high-value items, cash, jewelry, and sensitive personal documents before the Service Partner enters your premises. Servixo is not responsible for missing or damaged personal belongings.
  • No Harassment: We enforce a Zero-Tolerance Policy against any form of physical, verbal, or mental abuse, harassment, discrimination (based on religion, caste, gender, or background), or threat directed at our Service Partners.
  • Special Safety for Female Service Partners: For services like “At-Home Salon & Beauty Care” delivered by female professionals, an adult family member must be present in the home for the entire duration of the service. Any inappropriate behavior will result in immediate termination of the service, a permanent ban, and referral to the local Darbhanga Police.

B. Direct Booking Bypass Prohibited

To maintain the security and viability of our platform, you agree not to solicit, negotiate, or engage in direct off-platform business agreements with our Service Partners for subsequent jobs without booking through Servixo. By bypassing our platform, you lose all access to our dispute resolution, screening support, and safety tracking, and we reserve the right to blacklist both the customer and the partner.

7. Category-Specific Disclaimers and Limitations

To avoid misunderstandings, please review these category-specific terms:

  • 01. Home Repair (Electrician, Plumbing, AC, etc.): We do not guarantee structural elements of your building. If a repair requires drilling or breaking walls, the Service Partner is not responsible for restoring cosmetic finishes (such as matching paint or plaster) unless explicitly agreed upon in writing beforehand.
  • 02. Education & Home Tutors: Servixo merely introduces verified tutors. We make absolutely no guarantees regarding a student’s academic grades, test scores, exam clearing, or learning pace. Parents are expected to have an adult present in the household during all tutoring sessions.
  • 03. Digital Services (Web Design, Marketing): Digital deliverables depend on your timely feedback and assets (images, text, login access). Servixo is not liable for fluctuations in search rankings, ad performance, social media algorithm changes, or business revenue outcomes.
  • 04. Document Help (Online Forms, Certificates): We assist with clerical data entry and scanning. We are not responsible for the rejection of your government forms, late processing by government offices, or inaccuracies in documents issued by third-party departments.
  • 10. Emergency & Roadside Services: Roadside assistance and urgent plumbing repairs depend heavily on traffic, weather conditions, and partner availability in your sector of Darbhanga. We do not guarantee fixed response times during natural monsoons, waterlogging, or local strikes (bandhs).

8. Limitation of Liability and Indemnification

Please read this section carefully, as it defines the limits of our financial and legal accountability.

A. General Exclusion

  • Delays or failure in performance resulting from causes beyond our reasonable control (Force Majeure).

B. Maximum Liability Cap

In the event that Servixo is found liable by a competent court of law despite the exclusions above, our total aggregate liability to you for any and all claims arising out of your use of the Website or services shall not exceed ₹1,000 (One Thousand Indian Rupees) or the estimation value of the specific service booking out of which the dispute arose, whichever is lower.

C. Indemnification

You agree to defend, indemnify, and hold harmless Servixo, its founders, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:

  1. Your violation of any clause in these Terms and Conditions.
  2. Your negligent or willful misconduct on the premises where a service is performed.
  3. Your infringement of any third-party rights, including property, privacy, or safety rights.

9. Intellectual Property & User Feedback

A. Platform Content

All text, graphics, logos, button icons, images, slogans (specifically “Kaam Koi Bhi, Solution SerVixo”), audio clips, and software on the Website are the exclusive property of Servixo or its content suppliers and are protected by Indian and international copyright and trademark laws. You may not copy, frame, scrape, or commercially exploit any content from our platform without our prior written consent.

B. User-Submitted Reviews and Photos

By submitting reviews, ratings, suggestions, or photos of completed work to us (via WhatsApp or WordPress comments), you grant Servixo a non-exclusive, royalty-free, perpetual, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, and display such content across our social media channels, promotional flyers, and Website. You represent that your submitted feedback is honest, accurate, and does not violate the rights of any third party.

10. General Provisions

A. Force Majeure

Servixo shall not be held responsible or liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, extreme monsoons, severe flooding in the Darbhanga/Mithila region, earthquakes, strikes, civil unrest, government regulations, internet outages, telecommunication grid failures, or public health emergencies.

B. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that specific provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

C. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in the future.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
